Contentahealth, LLC (“the Practice,” “we,” “us,” or “our”)
1. Agreement to Terms
These Text Messaging Terms & Conditions (“Terms”) govern your participation in the text (SMS/MMS) messaging communication program offered by Contentahealth, LLC. By providing your mobile phone number and affirmatively opting in, you agree to these Terms. If you do not agree, please do not opt in to text communications; you may instead contact us by phone, patient portal, or fax.
2. Scope of the Texting Program
The Practice’s texting program is limited to administrative and scheduling communications, including but not limited to:
- Appointment scheduling
- Rescheduling or cancellation notices
Text messaging is not used to provide therapy, counseling, clinical assessment, diagnosis, treatment recommendations, or any other clinical service. No clinician-client relationship communication of a clinical nature will occur by text, and clients should not use text messages to convey clinical information, symptoms, or concerns requiring a clinical response.
3. Consent to Receive Text Messages
By opting in, you expressly consent to receive automated and/or manually sent text messages from the Practice at the mobile number you provide, in accordance with the Telephone Consumer Protection Act (TCPA) and other applicable law. Consent to receive texts is not a condition of receiving services from the Practice. You may still receive full clinical services if you decline to opt in to texting.
You represent that the mobile number you provide is your own and that you are authorized to receive text messages at that number.
4. Message Frequency and Fees
Message frequency will vary depending on your appointment schedule and administrative needs, and generally will not exceed a few messages per week. Message and data rates may apply based on your mobile carrier plan. The Practice is not responsible for any charges imposed by your mobile carrier for sent or received messages.
5. How to Opt Out
You may opt out of text messaging at any time by replying “STOP” to any message, or by contacting the Practice directly using the information in Section 10. After opting out, you will receive a final confirmation message, and no further texts will be sent unless you opt back in. Standard rates may apply to the confirmation message. You may also text “HELP” for assistance, or contact the office directly.
6. No Guarantee of Delivery or Confidentiality
Text messaging relies on mobile carrier networks and third-party platforms outside the Practice’s direct control. The Practice does not guarantee that messages will be delivered, received, or read in a timely manner, or at all. Text messages are not a secure or encrypted communication channel, and confidentiality cannot be guaranteed once a message is sent. You accept these limitations as a condition of opting in to text communications.
7. Not for Emergency or Urgent Use
The texting program is not monitored continuously and must not be used for emergencies, crises, or urgent matters requiring an immediate response. In an emergency, call 911 or go to the nearest emergency room. If you are experiencing a mental health crisis, call or text 988 (Suicide & Crisis Lifeline), available 24/7. The Practice is not responsible for any delay in response to a text message, including messages describing urgent or emergency circumstances.
8. Client Responsibilities
- Notify the Practice promptly if your mobile phone number changes or is no longer in service.
- Do not share your mobile device or text messages from the Practice with unauthorized individuals if you wish to maintain confidentiality of appointment information.
- Refrain from sending clinical, diagnostic, or sensitive health information by text.
- Understand that texts may be visible to others with access to your device.
9. Changes to the Texting Program
The Practice may modify, suspend, or discontinue the texting program, or these Terms, at any time, with reasonable notice where practicable. Continued participation in the texting program after changes are communicated constitutes acceptance of the revised Terms.
